These terms of use and sale (“Terms”) are for our NUVExperience website and for the purchase of our products and services. In these Terms, ‘we’, ‘us’ and ‘our’ mean Nuve Limited, a company register in the United Kingdom.

These Terms apply to anyone who interacts or purchases products with us (‘you’, ‘your’) on our website (nuvexperience.com), by email, through our apps (our “Website”). Please read the following Terms carefully. These Terms, together with any documents referred to below, set out the legal terms that apply to your use of our Website.

By accessing and using our Website, you agree these Terms will apply to you and any products and services offered for sale and available on our Website (together being “Products’). If you do not agree to these Terms, do not use our Website.

Our Website is designed for all internet users. We welcome your feedback on our Website, either at the point of access or by emailing us at any time. Use of our Website is also governed by the following:

Sales of our Products

Prices & availability

All Product prices are set out on our Website. We reserve the right to modify prices at any time. All prices at point that payment is made are final. Our Product availability may change during browsing and is not reserved until payment is made.

Exchanges or returns

By purchasing our Products, you are joining our growing community, and helping us to validate our Products. We are therefore currently not able to offer refunds or exchanges at this time. We hope to change this as we grow.

If you consider the Product you purchase is defective on delivery, please contact us as soon as possible by emailing info@nuvexperience.com. We will evaluate if your Product has suffered from a manufacturing defect. If it has, we will offer a replacement or full refund if the Product is not available.

Right to cancel

You have the right to cancel your physical goods order within 14 days of purchase and receive a full refund for the Goods, provided they are returned in the original condition and sealed packaging. Any Goods that are damaged, soiled or opened will be refused and therefore not reimbursed. The customer will be reimbursed excluding the original shipping costs and any customs duties paid within 30 days after receipt of the Goods back to NUVE by bank transfer. The customer is responsible for any charges relating to the return of the Goods.

Payment & order acceptance

Prices for Products on our Website are quoted in GBP [British Pounds] the currency conversion will be dictated by the market exchange rate at the time of purchase.

We use Stripe as our payment processor and accept payment methods including Visa, Mastercard and Apple Pay. Data will be processed by Stripe on its system within our Website, using secure socket layer (SSL) encryption which encrypts your information before it is sent to us, to protect it from unauthorised disclosure or use.

When you make a payment, you can either set up an account or checkout as a guest. You will need to include your name, mailing address, email address and billing information, and we use this information for your payment transaction. This information will not be used for any third-party marketing purposes.

The use of e-voucher codes are accepted against full price purchases.

All prices for our Products on the Website include appropriate value added tax (VAT) or sales tax. For all sales made in the United Kingdom and the EU, VAT will apply. Outside of the UK and EU, depending on where you are located, relevant sales or related taxes may apply.

Our Products are manufactured and shipped from the European Union. Products delivered outside of the European Union, depending on the shipping location, may require the payment of additional local duties, payable by You on receipt of the order.

Our products are currently available for delivery to a limited number of countries. We hope to expand over time and will update our website accordingly. Please select your country at shipping page to see if we ship to that location.

We reserve the right to limit or adjust the amount of sales made/accepted on our Products and via our Website in order to minimise any potential supply issues.

E-Vouchers

E-vouchers can be redeemed against any full price item on the website. Vouchers are non refundable and must be redeemed within 12 months of purchase. If an order is greater than the value of the e-voucher, the remaining balance must be paid by credit/debit card. If an order is less than the value of the e-voucher, the balance will remain on the e-voucher code. We are unable to replace e-vouchers if they are lost or deleted.

Shipping Terms

Physical orders are dispatched within 48hrs of your order being placed, with a cut off time of 1400 CET on the day of purchase. Deliveries will be made by NUVE’s distribution specialist from within the EU. Timings will differ depending on the region and based on your delivery address stated. Shipping costs include a tracked service with damage protection cover.

For orders to the UK or within mainland Europe, we offer free shipping on orders over £220, otherwise charges will apply, fees will depend on which country you are shipping to.

Account and signing up for information

We are establishing an exciting community of city riders, and enthusiasts at the intersect of arts, fashion, cycling and city culture. Our Customers can sign up for updates on the Products we sell. When a customer signs up for updates, they will receive updates regarding stories and products of NUVE (eg, New items, products back in stock or new stories that inspire new products for the community).

We are responsible for what we do with your information. If you sign up for an account, we will use this information to provide you stories and updates. We will not otherwise share your info for third-party marketing purposes.

Changes and updates

From time to time, we may revise or update these Terms. Your continued use of our Website or purchasing Products following any changes will confirm your acceptance of these changes. You are responsible to check if any changes have been made since your last visit.

Sometimes and possibly without notice, we may have to withdraw or suspend access to some or all of the Products or pages available on our Website. This is often to allow us to maintain or protect our Website or due to Product production or supply issues. Whilst we do not expect this to happen regularly, if it does, we apologise if any inconvenience is caused. Please note, however, that we are not liable for any loss or inconvenience you may suffer should our Website or any Products become unavailable at any time or for any period.

As a user of our Website, in the event your breach any of these Terms, your right to use our Website will cease immediately.

If we are found to be liable to you for any damage or loss (including through negligence) which arises in any way out of, or is in any way connected with, your use of our Website or any Products or service, to the extent allow under applicable law, our liability shall not exceed the total of three hundred and twenty five pounds sterling (£325).

General terms

If any part of these Terms is deemed invalid, illegal, or for any reason unenforceable, then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these Terms or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.

Governing law

These Terms and any dispute or claim arising out of our Website or Products, including any IPR infringement or dispute will be governed by English law. The courts of England & Wales will have exclusive jurisdiction over any claim arising from any use of our Website or its Products, however we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.
